August 3, 1989 THE ELLSWORTH AMERICAN, ELLSWORTH, MAINE 04605 Section Page ELEVEN Ellsworth Planning Board Reviews Shoreland Permits By Jan Vertefeuille The first request on the Ellsworth Planning Board's agenda last night was approved with no changes, but the rest of the applications didn't get by so easily. A request for a shoreland permit from Brenda and Roy Kelshaw for a two-bedroom cottage on Branch Lake was approved after being tabled from the June meeting for lack of necessary information. A shoreland permit was denied to Edward Nester, however, to allow him to put a roof over an existing deck on his Green Lake house and screen the porch in. The deck is about 40 feet from the water and can not be enlarged because an addition would be considered a nonconforming use. "I have to argue that the addition of a roof is an expansion," Vice Chairman Lawrence King said.

New board member Ann Hessler asked whether it would be possible to screen in a porch with an existing roof and the board decided that was acceptable. A shoreland permit application by Mary and Robert Hanley to build a three-bedroom house on Branch Pond was tabled a second time because part of the couple's application had not been signed by their soil scientist: The Hanleys had applied for and received a permit to build in 1986. But they have not built their house yet, and the permit is now obsolete. Robert Hanley said the soil scientist had updated the permit, but since he did not sign and date it, the application was tabled until September. Stephen Salsbury's request for a shoreland permit turned into a debate on the merits of certain state requirements when he was told he could not use 1,350 yards of soil to fill in his land and make a lawn in front of a proposed house on Branch Lake.

City planner Liz Hooper said since the land is within 75 feet of the high water mark, it is in a resource protection zone and no one can place fill there. Salsbury's application for a permit to build a three-bedroom house, a apartment, and a septic system finally was approved after he agreed to give up plans to dump fill within 75 feet of the water. Bruce Tetrault withdrew his application for a special exception for a structure to house a one car garage and gallery for the sale of art glass after the board told him he could simply get a building permit for a garage if he did not use the building for retail sales. Mr. and Mrs.

Robert Woodward, who own a condominium on Green Lake, decided to scale back the size of a proposed porch on their house during last night's meeting rather than bring it back before the board in September. Planning board members told the couple that the porch, which would replace an existing one, was about 40 square feet too big. Shoreland zoning ordinances require that an expansion be no larger than 30 percent the size of the house and the Woodward's was a little too long. Maid Arrested In Jewel Theft By Earl Brechlin A 26-year-old woman working as a maid at a Northeast Harbor summer estate remains in the Hanco*ck County jail after being arrested on a charge of Class theft last week in connection with the disappearance of $27,000 in jewelry, cash, and checks. Maria Lourdes Yap, a Philippine national most recently living in Newton, was arrested by Officer Tom Jordan on July 25 after her employer, Marie Butler, at the Villa Maria Cottage reported that several necklaces and bracelets worth more than $25,000 were missing.

Approximately $1,500 in cash and checks was also reported stolen. According to police, some of the missing items and cash were recovered. Investigators' say they believe the balance has been mailed to the Philippines. On Tuesday of this week, police searched an intercepted package reportedly mailed by Yap just after the theft. Although the large envelope contained what police suspect is Butler's missing purse, none of the missing jewelry or cash was found.

Yap remains in jail, unable to post a $10,000 cash bail. According to Ed Mandell, Mount Desert police chief, agents from the U.S. Border Patrol have already confiscated her passport. Conviction of a Class offense carries a possible sentence of up to 10 years a fine of up to $10,000. AG to Speak on Soviet Criminal Law State Attorney General James Tierney will discuss criminal law in the Soviet Union in a talk next Monday evening, Aug.

7, at George Stevens Academy. The lecture is part of the continuing Summer Speakers Series, and will take place in the Esther Wood Lecture Room beginning at 7:30 p.m. Tierney has titled his talk, "Peristroika and the Criminal Law, or You May Someday Have the Right to an Attorney, Tierney attended the University of Maine School of Law and was admitted to the Maine Bar in February 1975. Until his election as Attorney General, he was a partner in the Brunswick law firm of McTeague, Higbee and Tierney. He served eight years in the Maine Legislature, four as Majority Leader of the House of Representatives.

Tierney is the vice -chair of the National association for Attorneys General Civil Rights Committee. He has been active in a wide variety of Blue Hill Trust to Host Speaker Cherie Mason will be the speaker at the annual meeting of the Blue Hill Heritage Trust on Tuesday, Aug. 8, at 7:30 p.m. at the Blue Hill Country Club. He was a member of the Orland United Methodist Church. He is survived by his mother, Una Wardwell of Orland; his loving and devoted wife, Anne (Hamm) Wardwell of Orland; his four children and three daughters-in-law, John and Karen Wardwell, Robert and Robin Wardwell, Brian and Karen Wardwell, and Roxanne W.
